Terms
These terms apply when you use this website or buy from it. Please read them before you order. Nothing in these terms excludes, restricts or modifies any right you have under the Australian Consumer Law.
Who you are dealing with
This store is operated by VALEMADRE, a sole trader based in Victoria, Australia. You can reach us at valemadrecontact@gmail.com. Email is the fastest way to get an answer and the right way to raise anything about an order.
Who can order
You can order if you are 18 or over. If you are 16 or 17, you may order only with the consent of a parent or guardian, and they take responsibility for the order. We do not knowingly sell to anyone under 16.
How an order is made
Placing an order is an offer to buy. It is not accepted at the moment you pay. We accept your order when we send you a dispatch confirmation, and the contract between us is formed at that point.
Before we accept, we may decline or cancel an order and refund you in full. We would do that only for a genuine reason, such as a pricing or description error on the site, an item we cannot produce, an address we cannot ship to, or an order we reasonably suspect is fraudulent. If we cancel, we will tell you why.
Prices and payment
Prices are in Australian dollars. The price of the item, the shipping rate that applies and the total are all shown at checkout before you pay.
Payment is taken at checkout through our payment providers. We do not receive or store your full card details.
We try to keep prices and product information accurate. If an obvious error appears, such as a price that is clearly wrong, we may correct it before accepting your order rather than after. If that changes what you would pay, we will contact you and you can confirm or cancel.
Made to order
Items are produced after you buy them. Cancellation is possible before production begins. See our returns and refunds policy for how that works and for your rights if something is wrong with an order.
Delivery
Shipping rates, tracking, delays and responsibility for items in transit are covered in our shipping policy, which forms part of these terms.
Consumer guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Those rights, and how to make a claim, are set out in our returns and refunds policy. Nothing on this site or in these terms takes them away.
Your information
What we collect when you order, who it is shared with, which countries it goes to and how to get a copy or have it deleted are all set out on our privacy page.
Our artwork and brand
The VALEMADRE name, the wordmark, the garment artwork, the photography and the design of this site belong to us or are used with permission. Buying a garment gives you the garment. It does not give you a licence to reproduce, print, resell as your own, or make derivative works from the artwork or brand assets.
You are welcome to photograph and post the pieces you own.
Using this site
Use the site lawfully. Do not attempt to break into it, disrupt it, scrape it at a scale that degrades it for others, or use it to send anything unlawful. We may restrict access if that happens.
Our liability
Nothing in these terms excludes, restricts or modifies the consumer guarantees or any other right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
Where our liability can lawfully be limited, and where a failure is not a major failure, our liability is limited to replacing the goods, supplying equivalent goods, or paying the cost of doing so, at our election.
Beyond that, and again only where the law allows us to say so, we are not liable for loss that was not reasonably foreseeable, or for loss you suffer because of something outside our reasonable control.
Indemnity
If you break these terms, use the site unlawfully, or infringe our artwork or brand rights, you agree to cover the reasonable and direct costs we incur as a result. This does not apply to anything caused by us.
Changes to these terms
We may update these terms. The version that applies to your order is the version published when we accepted that order. Changes are not applied backwards to orders already accepted. Any updated version is posted on this page with a new date.
If something goes wrong
Email us first at valemadrecontact@gmail.com. Most problems are quicker to fix directly. If we cannot resolve it between us, you can contact the Australian Competition and Consumer Commission, or the consumer affairs or fair trading body in your state or territory. Those avenues remain open to you at any time and this clause does not restrict them.
Governing law
These terms are governed by the laws of Victoria, Australia. You and we submit to the non exclusive jurisdiction of the courts of that state, which does not stop you bringing a claim where you live if the law lets you.
If part of these terms does not hold
If any part of these terms is found to be unenforceable, that part is severed and the rest continues to apply.
